This policy explains how VKM Protune OÜ (“we”, “us”, “RaceTuneFiles”) collects, uses, and protects personal data when you use racetunefiles.com and our ECU file tuning service. We are the data controller for the purposes of the EU General Data Protection Regulation (GDPR).

1. What data we collect

• Account data — name, email address, company name and VAT number (if provided), password (stored hashed).
• Order data — the ECU binary and related files you upload, the modifications you request, vehicle details you enter, and the resulting tuned files.
• Payment data — credit purchases and invoices. Card details are processed by our payment provider; we do not store full card numbers.
• Communications — messages and notes exchanged about your orders, and support emails.
• Usage & device data — pages visited, approximate location, browser/device type, and similar analytics data (only with your consent — see Cookies below).

2. How we use your data

• To create and manage your account and process your orders.
• To deliver tuned files and provide customer support.
• To take payment, issue invoices, and meet accounting and tax obligations.
• To operate, secure, and improve the website and service.
• To measure traffic and understand how the site is used (analytics, with consent).

3. Legal bases (GDPR Art. 6)

• Contract — to provide the service you sign up for and process your orders.
• Legal obligation — to keep accounting and tax records.
• Legitimate interests — to secure the platform and prevent abuse.
• Consent — for analytics cookies; you can withdraw consent at any time.

4. Cookies & analytics

We use strictly necessary cookies that are required for the site and your session to work — these are always on. We also use Google Analytics to understand traffic and improve the site. Analytics cookies are only set after you accept them in the cookie banner; until then, no analytics cookies are stored and no analytics data is collected (we use Google Consent Mode for this).

You can change your choice at any time by clearing this site’s cookies and local storage in your browser, which will make the consent banner appear again.

5. Who we share data with

We use trusted third-party processors to run the service. They process data only on our instructions:

• Google Analytics (Google Ireland Ltd.) — website analytics.
• Stripe — payment processing.
• Dropbox — secure storage of your uploaded and tuned files.
• Email & hosting providers — to send transactional emails and host the platform.

We do not sell your personal data.

6. International transfers

Some processors may store or process data outside the European Economic Area. Where they do, the transfer is protected by appropriate safeguards such as the European Commission’s Standard Contractual Clauses.

7. How long we keep data

We keep account and order data for as long as your account is active and as needed to provide the service. Invoicing and accounting records are kept for the period required by Estonian law (generally 7 years). Uploaded and tuned files are retained to support re-downloads and follow-up work, and removed on request where we are not legally required to keep them.

8. Your rights

Under the GDPR you have the right to access, correct, delete, restrict, or object to the processing of your data, and to data portability. To exercise any of these, email info@racetunefiles.com.

You also have the right to lodge a complaint with the Estonian Data Protection Inspectorate (Andmekaitse Inspektsioon, aki.ee).

9. Security

We use appropriate technical and organisational measures to protect your data, including encrypted connections, hashed passwords, and access controls. No method of transmission or storage is completely secure, but we work to protect your data and review our measures regularly.

10. Changes to this policy

We may update this policy from time to time. The “Last updated” date above reflects the latest version. Material changes will be communicated where appropriate.
