Adding refrigerant will not fix it and overcharging the system risks damaging the compressor.

Will this fail an emissions test?
Yes, in most OBD-based inspection programmes, purely because the check engine light is on and the code is stored. The air conditioning system itself does not affect tailpipe emissions, but an illuminated lamp is an automatic fail.
